1. General Provisions and Definitions

The operator of the Lulashop.sk e-shop is CSMD s.r.o.:

(hereinafter referred to as the "Seller")

The Buyer is a natural or legal person who submits an electronic order for goods via the website Lulashop.sk.

2. Order and Conclusion of Contract

The purchase contract is concluded upon confirmation of the order by the Seller. Before submitting the order, the Buyer has the opportunity to check and correct the entered data. After submitting the order, the Buyer will receive an automatic confirmation by email. The Seller reserves the right to refuse an order in justified cases (e.g., unavailability of goods).

3. Prices and Payment Terms

The prices listed on the website include statutory VAT (if the Seller is a VAT payer). We offer the following payment methods:

Online card payment
Bank transfer
Cash on delivery (payment upon receipt of goods)
Cash payment upon personal pickup

4. Delivery of Goods

We strive for fast processing. Goods are usually dispatched within 1–3 working days, but no later than 30 days. Ownership of the goods passes to the Buyer upon full payment and acceptance of the goods.

5. Withdrawal from Contract

The consumer has the right to withdraw from the contract without giving any reason within 14 days of receiving the goods. The costs of returning the goods are borne by the Buyer. The Seller will refund all payments received within 14 days of processing the withdrawal. Exception: The right of withdrawal does not exist for goods made or adapted according to the Buyer's specifications (custom-made goods).

6. Complaints and Warranty

The statutory warranty period is 24 months from the receipt of the goods. Complaints can be submitted in writing by email or post to the Seller's address. The Seller will decide on the complaint within the statutory period of a maximum of 30 days.

7. User Account

Registration of a user account on Lulashop.sk is voluntary. The Seller reserves the right to delete accounts that have not been actively used for more than 12 months.

8. Data Protection

The protection of your personal data is important to us. Processing is carried out in accordance with the GDPR (EU 2016/679) and Slovak Act No. 18/2018 Z.z. For detailed information, please refer to our document "Privacy Policy".

9. Limitation of Liability

The Seller is not liable for technical failures of the e-shop, delivery delays caused by the carrier, or errors arising from incorrect or incomplete data provided by the Buyer.

10. Protection of Intellectual Property

All content of the Lulashop.sk website, including texts, photographs, and graphics, is protected by copyright and is the property of the Seller or its partners. Use without prior consent is not permitted.

11. Dispute Resolution

In the event of disputes, the Buyer has the option to contact the Slovak Trade Inspection (Slovenská obchodná inšpekcia) or the European online dispute resolution platform (ODR): https://ec.europa.eu/consumers/odr

12. Final Provisions

All legal relations between the Seller and the Buyer are governed by the laws of the Slovak Republic. These General Terms and Conditions enter into force on 19.05.2026.

I. Basic Provisions

The controller of personal data pursuant to Article 4 point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (hereinafter: "GDPR") is:

The Controller has not appointed a data protection officer.

II. Sources and Categories of Personal Data Processed

The Controller processes personal data that you have provided or that the Controller has obtained based on the fulfillment of your order: identification and contact data, order data, technical data (IP address, cookies, browser data, behavior on the website).

III. Legal Basis and Purpose of Processing

The legal basis for processing personal data is:

Performance of contract: Article 6(1)(b) GDPR.
Legal obligation: Article 6(1)(c) GDPR (e.g., accounting).
Legitimate interest: Article 6(1)(f) GDPR (direct marketing to existing customers).
Consent: Article 6(1)(a) GDPR (marketing to new visitors, certain cookies).

The Controller does not perform automatic individual decision-making within the meaning of Article 22 GDPR.

IV. Data Retention Period

The Controller stores personal data:

For the period necessary to exercise the rights and obligations arising from the contractual relationship (10 years for accounting reasons).
Until the consent for marketing processing is withdrawn (maximum 10 years).

After the expiry of the retention period, the Controller deletes the personal data.

V. Recipients of Personal Data

The recipients of personal data are persons:

Involved in the delivery of goods / execution of payments based on the contract (transport companies, payment gateways and banks).
Providing e-shop operation services and other services (IT providers, hosting, newsletter system, accounting firm).
Providing marketing services (Google Analytics, Google Ads, Facebook Pixel).

The Controller does not intend to transfer personal data to a third country (outside the EU) or international organization.

VI. Cookies

Technical cookies: Necessary for cart operation and login (without consent).
Analytical cookies: For traffic measurement (with consent).
Marketing cookies: For targeted advertising (with consent).

VII. Newsletter

By subscribing to the newsletter, you give consent for the processing of your email address. You can unsubscribe at any time.

VIII. Your Rights

Under the conditions set out in the GDPR, you have:

Right of access to your personal data (Article 15 GDPR).
Right to rectification of personal data (Article 16 GDPR).
Right to erasure ("right to be forgotten") (Article 17 GDPR).
Right to restriction of processing (Article 18 GDPR).
Right to data portability (Article 20 GDPR).
Right to object to processing (Article 21 GDPR).
Right to withdraw consent in writing or electronically.
Right to file a complaint with the Office for Personal Data Protection of the Slovak Republic.

IX. Personal Data Security

The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data, including for data stores in paper form. Only authorized persons have access to personal data.

X. Final Provisions

By submitting an order from the online order form, you confirm that you are familiar with these privacy conditions and accept them in their entirety. The Controller is entitled to change these conditions and will publish the new version on its website.

These conditions take effect on 19.05.2026.
